1. Scope
These General Terms and Conditions apply to all business relationships between Elite Gardinen und Heimtextilien GmbH and its customers in the version valid at the time the contract is concluded.
A consumer within the meaning of these terms and conditions is any natural person who concludes a legal transaction for purposes that can predominantly be attributed neither to his commercial nor to his independent professional activity.
An entrepreneur is any natural or legal person or partnership with legal capacity who, when concluding the contract, is acting in the exercise of his or her commercial or independent activity.
The contract language is German.
2. Conclusion of contract
The products presented in the online shop do not constitute a legally binding offer, but serve to submit a binding offer by the customer.
By submitting the order, the customer submits a binding offer. Acceptance is confirmed by an order confirmation via email.
Elite Gardinen und Heimtextilien GmbH is entitled to accept the customer’s offer within 5 working days.
The contract text is not stored permanently, but is sent to the customer by email after the order.
3. Prices and payment terms
All prices stated in the online shop are gross prices and include VAT .
The final prices including shipping costs are shown to the customer during the ordering process.

4. Delivery and shipping
Delivery times vary depending on the product type and are between 5 and 50 working days from receipt of payment.
The specific delivery time is specified for each product on the respective order page.
During peak season or for custom orders (e.g. special colors), delivery times may be longer.
In the event of delivery delays due to force majeure or unforeseeable production bottlenecks, the customer will be informed immediately. Claims for damages are excluded in such cases.
Delivery is handled by a reliable shipping service provider. Shipping costs are clearly displayed to the customer during the ordering process.
5. Right of withdrawal for consumers
5.1 Cancellation policy
Consumers have the right to withdraw from the contract within 14 days without giving any reason. This period begins on the day on which you or a third party designated by you (not the delivery service) received the goods. In the case of partial deliveries, the period begins upon receipt of the last shipment.
To exercise the right of withdrawal, a clear declaration (e.g. by letter or email) is required.

To meet the deadline, it is sufficient to send the declaration of revocation in good time.
Consequences of revocation:
In case of a valid cancellation, we will refund all payments, including standard shipping costs, within 14 days of receipt of the cancellation notice. The refund will be made using the same payment method used for the purchase, unless otherwise agreed. There will be no additional costs for the refund.
5.2 Exclusion of the right of withdrawal
The right of withdrawal does not apply to contracts for the delivery of goods that are manufactured according to customer specifications or are clearly tailored to personal needs (Section 312g Paragraph 2 No. 1 of the German Civil Code).
6. Warranty and guarantee
The statutory warranty rights apply to all goods offered.
Warranty claims only exist if they are expressly stated in the respective item description or order confirmation.
7. Liability
In the event of slightly negligent breaches of duty, the liability of Elite Gardinen und Heimtextilien GmbH is limited to the typical, foreseeable and immediate average damage.
In the event of intentional or grossly negligent breach of duty or injury to life, body or health, the company shall be liable without limitation in accordance with statutory provisions.
8. Data protection
Personal data required to process the order will be processed in accordance with the General Data Protection Regulation (GDPR) and the Federal Data Protection Act (BDSG) and treated confidentially.
The data will be used exclusively for contract processing and will not be passed on to third parties without your express consent.
9. Online dispute resolution
The European Commission provides a platform for online dispute resolution (ODR platform), which you can access at the following link:

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
